Regulations on the X Photo Contest of the Russian Geographical Society «The Most Beautiful Country»

  1. General Provisions
    1. The X Photo Contest of the Russian Geographical Society "The Most Beautiful Country" (hereinafter, the “Photo Contest”) is held in order to draw attention to the issues of the natural, historical and cultural heritage of Russia, foster patriotism and respect for the environment through the art of photography.
    2. The Organizer of the Photo Contest "The Most Beautiful Country" is the All-Russian Public Organization "Russian Geographical Society" (PSRN 1037858010970, TIN 7812011023) (hereinafter, the “Society”).
    3. The Organizer of the Photo Contest is the copyright holder of САМАЯ КРАСИВАЯ СТРАНА (“The Most Beautiful Country”) trademark (Certificate for the trademark (service mark) No. 596181, registered in the State Register of Trademarks and Service Marks of the Russian Federation on November 24, 2016).
    4. The Organizer of the Photo Contest:
      1. establishes the terms and rules for the Photo Contest;
      2. appoints the Expert Commission and the Jury of the Photo Contest (hereinafter, the “Expert Commission”, “Jury”).
    5. The Photo Contest begins accepting submissions on January 18, 2024.
    6. The Photo Contest is held in 4 (four) stages:
      1. 1st stage "Accepting submissions" – from January 18, 2024 to March 31, 2024;
      2. 2nd stage "Selection" – the work of the Expert Commission begins on March 31 and ends with giving points for all the photographs that meet the criteria of the Photo Contest. The works that have received the highest scores from the members of the Expert Commission are allowed to the next stage of the Photo Contest – "Semi-final".
      3. 3rd stage "Semi-final" – an in-person meeting of the Expert Commission, which will determine the works that will be the finalists of the Photo Contest.
      4. 4th stage "Final" – a meeting of the Jury members (the date will be published on the Photo Contest websites photo.rgo.ru, photo-children.rgo.ru) or absentee voting of the Jury members.
    7. The results of the Photo Contest are published on the sites of the Photo Contest photo.rgo.ru, photo-children.rgo.ru (hereinafter, the “sites of the Photo Contest”).
    8. These Regulations are an offer that is accepted by the Participant of the Photo Contest at the time of uploading photos/videos to the Photo Contest website.
    9. The Participant of the Photo Contest, in accordance with Article 434 of the Civil Code of the Russian Federation, acknowledges and agrees that the written form of the transaction (the placement by the Society on the Photo Contest website (photo.rgo.ru, photochildren.rgo.ru) of this offer, including the License Agreement and the acceptance of this offer by the Participant of the Photo Contest by uploading a photo/video to the Photo Contest website) is considered to be complied with.
  2. Categories of the Photo Contest
    1. The Photo Contest includes the following categories:
      1. LANDSCAPE. Pictures showing the greatness, diversity and beauty of the pristine nature of the country. Forests and fields, mountains and waterfalls, rivers and lakes, seas and oceans. Pictures full of grandeur and space, or small-scale ones, idyllic and pastoral, full of colors and emotions, or melancholy. The presence of urban elements in the shot is allowed only as an exception, as compositionally justified details, but not as the main subject of the pictute.
      2. WILD ANIMALS. Vivid moments from the life of wild animals in their natural habitat. The category accepts pictures of all animals without exception, excluding birds.
      3. BIRDS. Scenes from the life of wild birds, their beauty, interaction with each other and the environment.
      4. ELEMENTAL MAGIC. Natural phenomena in all their diversity and beauty. Pictures of storms and thunderstorms, blizzards and snowfalls, ice drifts and floods. Shots filled with movement and emotions, the powerful energy of our planet, forcing you to bow before the greatness of nature and the power of the elements. Photos, in which it is not a person or animals, but the elements that became a source of inspiration for the photographer. Compositionally, situationally justified presence of people or animals in the shot is allowed, but not as the main subject of shooting.
      5. PHOTO PROJECT. A series of photographs (from 4 to 10 works) united by a common theme or visual design. It can be pictures from the life of a wild animal, a visual study of a natural phenomenon, etc. The presence of a person in the shot is allowed only in exceptional cases, as compositionally justified details, but not as the main subject of the picture.
      6. FACES OF RUSSIA. Ethnographic portraiture of the peoples of Russia. First of all, close-up portraits of people are accepted for the category. The category demonstrates the diversity of peoples living in our country, their characters, images.
      7. LIVE ARCHIVE. Contemporary photos, recreating archival ones. On the special page of this category, the Participants of the Photo Contest are provided with a set of photographs of Russia of the late 19th - first half of the 20th century from the archives of the Society and the archives of the partners of the category. Contemporary shots taken in the same place, if possible from the same angle as the corresponding archival photographs, are accepted for the Photo Contest.
        In addition, the Participants of the Contest can independently upload archival photographs and modern photographs created based on them. However, in this case, the Participant of the Photo Contest must simultaneously comply with two conditions – to be the author of modern photograph, as well as to have the rights to the archival photograph to be able to transfer the rights to these archival photographs to the Society in amount equal to the amount of rights stipulated in section 10 of this Regulation "License Agreement".
      8. ART OF WILDLIFE (FINE-ART PHOTOGRAPHY). Photos that create emotional and associative images (art objects) – from the macrocosm to filming from the Earth's orbit.
      9. MACROWORLD. Shots that convey the grace and complex organization of a world that is difficult to see with the naked eye.
      10. TAKEN ON A SMARTPHONE. Photos taken on a smartphone, that correspond to one of the main categories of the adult Photo Contest.
      11. THE MOST BEAUTIFUL DESKTOP WALLPAPER. An image that will be installed as a photo wallpaper on a computer desktop. It can be used as a background image on the Astra Linux operating system. The photos should reflect one of the main categories of the adult contest. The partner of the category is RusBITech-Astra LLC.
    2. The choice of the category to which the Photo Contest photograph is submitted is made by the Participant of the Photo Contest. The work must correspond to the theme of the category.
  3. «The Most Beautiful Country through the Eyes of Children»
    1. «The Most Beautiful Country through the Eyes of Children» is a Photo Contest for children of any country under the age of 16 (inclusive), as of January 18, 2024 (hereinafter, the «Photo Contest for Children»), held as part of the Photo Contest.
    2. Only the legal representative of a child is allowed to complete the registration procedure on the website of the Photo Contest and upload photos by the child in order for the child to participate in the Photo Contest for Children.
    3. Categories of the Photo Contest for Children:
      1. LANDSCAPE. Pictures showing the beauty, harmony and diversity of the landscapes of Russia.
      2. ANIMAL WORLD. Bright moments from the life of wild animals living in our country. Photographs of animals in their natural habitat are accepted. It is allowed to take pictures in zoos, however, only if the requirements of clause 7.2 of these Regulations are unconditionally met.
      3. MACROWORLD. Shots that convey the elegance and complex organization of the world, which is difficult to see with the naked eye. Photographs in which small natural objects are shown close-up. The beauty of the surrounding world is demonstrated in exquisitely beautiful details, distinguished by the subtle beauty of forms.
      4. NATURAL PHENOMENA. Photos of natural phenomena of different seasons in all their diversity.
    4. Photos taken both on a camera and on a mobile phone (smartphone) can be submitted to every category.
    5. The choice of the category to which the Photo Contest photograph is submitted is made by the Participant of the Photo Contest trough their legal representative. The photo must be taken in Russia and correspond to the theme of the category.
    6. Each Participant of the Photo Contest, through their legal representative, has the right to submit no more than 25 works to the Photo Contest for Children.
    7. The winners (child authors of the photos) in each category of the Photo Contest for Children will receive a certificate for 100,000 rubles to be used in the online store Photosale.
  4. Procedure for submitting applications for the Photo Contest
    1. Registration of Participants in the Photo Contest – authors of photographs / representatives of Participants-copyright holders of the photos taken in specially protected natural areas (in the case of uploading photos and videos obtained by means of camera traps (for Participants in the WILD ANIMALS category) (hereinafter, the “Participant”) – and their work takes place on the Photo Contest website photo.rgo.ru. After completing the registration procedure, a confirmation is sent to the e-mail specified during the registration.
    2. Registration of the Participants in the Photo Contest for Children "The Most Beautiful Country through the Eyes of Children" – representatives of minor authors of photographs and their works – takes place on the website of the Photo Contest for Children photo-children.rgo.ru. After completing the registration procedure, a confirmation is sent to the email specified during the registration.
    3. Upon registration, the Participant receives a login and password to access his/her personal account.
    4. After completing the registration, the Participant can start uploading photos.
    5. Each Participant has the right to submit to the Photo Contest no more than 25 works.
    6. The Participant independently chooses the category for his/her work, but by decision of the members of the Expert Commission or the Jury the photo can be transferred to another category.
    7. Photos must be uploaded no later than March 31, 2024, to participate in the Photo Contest. Until that time, the author has the right to edit, replace or delete previously uploaded works.
  5. Admission to participate in the Photo Contest
    1. A prerequisite for admission to participation in the Photo Contest is filling out a form, agreeing to the terms and conditions of the Photo Contest, passing identification by means of a mobile phone (SMS with a code).
    2. A person is allowed to participate in the Photo Contest if they comply with the requirements for photographs and other requirements established by these Regulations, including confirmation that the Participant is the legal owner of the photographs submitted to the Photo Contest.
  6. Requirements for the Participant of the Photo Contest
    1. Photographers from any country are allowed to participate, without age restrictions.
    2. The organizers (employees of the Executive Directorate of the Society, members of the governing bodies of the Society), members of the Jury and the Expert Commission, as well as their relatives are not allowed to participate in the Photo Contest.
    3. A prerequisite for participation in the Photo Contest is the Participant's compliance with the legislation of the Russian Federation, the rules of the Photo Contest described in the Regulations, ethical behavior towards cultural monuments, nature, animals and their habitat.
  7. Ethical requirements
    1. Participants in the Photo Contest must comply with the following ethical requirements:
      1. photographs of animals in captivity (with the exception of the rules of the Photo Contest for children prescribed in clause 7.2. of these Regulations) or images created using live bait are not accepted to participate in the Photo Contest;
      2. in order to obtain the necessary shot, photographers should not disturb the natural way of life of their subjects;
      3. works should not mislead the viewer, mask or distort the real picture of nature and cultural objects;
      4. in order to obtain the necessary shot, the Participants of the Photo Contest must not take any actions that entail harm to nature, cultural monuments or disrupt the natural way of life of animals.
    2. In the Photo Contest for Children in the ANIMAL WORLD category, photos taken in zoos are accepted, but only in those that are members of the World Association of Zoos and Aquariums (WAZA, https://www.waza.org)/the Eurasian Regional Association of Zoos and Aquariums (EARAZA, http://earaza.ru). Following this rule implies compliance with the Code of Ethics and obligations regarding the well-being of the animals adopted by the above organizations.
    3. In categories where portrait photography is provided, photographers must provide a model release (the model's consent to the publication and further use of the photograph by the photographer).
    4. If the Organizer of the Photo Contest has doubts that the photo submitted for the Photo Contest was obtained without the use of cruel or illegal, including from an ethical point of view, actions, such work will not be accepted for consideration.
  8. Requirements for photographs
    1. Photographs that correspond to the themes of the categories of the Photo Contest, taken exclusively on the territory of the Russian Federation not earlier than 2020, are accepted to participate in the Photo Contest.
    2. Photos taken on a camera can be submitted to each category. The exception is the category TAKEN ON A SMARTPHONE.
    3. The same photo cannot be submitted in several categories.
    4. Photos that have become finalists or winners of previous Photo Contests of the RGS "The Most Beautiful Country", "The Most Beautiful Country Through the Eyes of Children" are not accepted for participation in the Photo Contest.
    5. Photos with images of pets (cats, dogs, parrots, etc.) and domestic plants are not accepted to participate in the Photo Contest.
    6. The photographs submitted to the Photo Contest must be accompanied by information about the shooting (the name of the work provided by the author, a description of the object depicted in the photograph, the type of animal, bird or plant, whether the species is listed in the Red Book, whether a bait was used (if yes, which one), a short history of the photograph, place where it was taken, model release (if people are captured in the picture). Also welcome is an additional presentation in the form of a short video, which most fully reveals the idea of the photo sent to the contest. From the moment of uploading the specified video, the Participant of the Photo Contest transfers to the Society a non-exclusive license to use this video in the amount and on the terms specified in section 10 of these Regulations "License Agreement". When submitting photos to the category "ANIMAL WORLD" of the Photo Contest for Children, it should be separately noted if the photo was taken at a zoo with the name of the zoo that is a member of WAZA/EARAZA.
    7. Competition works (photographs) must be submitted in digital format (images in the form of scanned transparencies or high-resolution negatives are allowed).
    8. Digital files should be provided in JPEG format. The image size is at least 2,500 on its long side, and the resolution is 72 dpi. Image upscaling is not allowed. It is preferable that the image file contains the working space profile to maintain correct color rendering (sRGB or Grayscale profile). The exception is the category THE MOST BEAUTIFUL DESKTOP WALLPAPER.
    9. The category THE MOST BEAUTIFUL DESKTOP WALLPAPER accepts digital files provided in JPEG format. The image size should be at least 6000x4000 pixels. The resolution is 72 dpi. Image upscaling is not allowed. It is preferable that the image file contains the working space profile to maintain correct color rendering The background should not be too bright, noisy or detailed so that the icons and text on a desktop can be clearly visible. The photo should contain rich and vibrant colors that will be pleasing to the eye and create a working mood. However, too bright or harsh colors should be avoided so as not to distract the user from work. The photos should reflect one of the main categories of the adult contest.
    10. For an impartial expert assessment and the work of the Jury, the Participants in the Photo Contest must not indicate their name either in the photograph, in the title of the photograph, or in the EXIF data for photographs.
    11. Photos must contain complete EXIF data of the image (camera name, lens used, exposure parameters, etc.). Contest entries should not have any author's captions, added frames, watermarks, signatures, etc.
    12. Digital manipulation of the photograph (editing) should not distort the content of the picture. Minor digital adjustments are allowed, including hue and contrast, exposure, cropping, sharpening, noise reduction, slight trimming, merging to HDR. Stitched panoramic shots, focus stacking using multiple exposures taken from the same point at the same time are allowed provided that the work does not violate the basic principles of photographic authenticity and does not distort the real picture of nature. Information about the photos that have been processed must be provided in full in the description of the photo and contribute to a truthful display of reality.
    13. Adding or removing objects, animals or their parts, as well as plants, people, etc. in photos is not allowed.
    14. Participants whose photographs have passed to the fourth stage of the Photo Contest must submit their work in RAW format (.CR2, .NEF, .ORF, .PEF, etc.) or original uncorrected JPEG files, as well as originals of transparencies or negatives. DNG files are only allowed if they are the primary RAW format of the camera.
    15. If a photo fails to comply with the requirements stated in clause 8.13, the Organizer of the Photo Contest reserves the right to remove the photo from the Photo Contest.
    16. Works submitted to the Photo Contest in unacceptable quality, or works whose authenticity cannot be verified, will not be accepted for consideration or will be disqualified.
  9. Assessment of works. Determination of the winners of the Photo Contest. Prizes
    1. The initial assessment of the works submitted to the Photo Contest is carried out at the second stage of the project by the members of the Expert Commission. The list of the members of the Expert Commission is published on the website of the Photo Contest. Each expert evaluates photographs on a five-point scale.
    2. The members of the Expert Commission have the right to change their assessment during the entire pre-selection period.
    3. The site system of the Photo Contest automatically selects works in each category that received an average rating of the members of the Expert Commission of 4 and higher. These works go to the "Semi-final" stage.
    4. At the "Semi-final" stage, the selection of the finalists from among the photographs that received the highest scores is carried out by the members of the Expert Commission, in-person, at a general meeting at the Society's Headquarters in Moscow, in the presence of the Chairman of the Jury. At the in-person meeting, the members of the Expert Commission openly vote to select up to 10 (ten) best photos in each of the categories of the Photo Contest and up to 5 (five) best photos in each of the categories of the Photo Contest for Children. Information about the photographs that have passed to the Final of the Photo Contest is entered into the minutes of the meeting of the Expert Commission.
    5. All works that have reached the Final are posted on a special page of the Photo Contest website for the purpose of conducting an open vote among Internet users and determining the winner of the "PEOPLE’S CHOCE AWARD". The work that receives the highest number of user votes becomes the owner of the "PEOPLE’S CHOCE AWARD".
    6. The terms, conditions and duration of open voting are determined by the Organizer of the Photo Contest and are published on the Photo Contest website photo.rgo.ru.
    7. The Organizer of the Photo Contest has the right to check the reliability of the results of open voting. If facts of intentional artificial increase in the number of those who voted for specific photos are discovered, the Organizer of the Photo Contest has the right to change the decision on the winner of the vote. The final decision on the winner of the "PEOPLE’S CHOCE AWARD" is approved by the Jury of the Photo Contest.
    8. The Organizer of the Photo Contest sends a request for the provision of the original files (RAW) and other necessary information about the shooting parameters to the Participants whose works reached the Final.
    9. Selected photographs undergo additional verification of the authenticity and compliance with the Photo Contest requirements (in terms of compliance with ethical standards, the use of photo editors, etc.), verification by expert geographers, ethnographers, historians, culturologists, biologists, as well as technical expertise.
      If the photo successfully passes additional verification of authenticity and compliance with the competition requirements, it receives the status of a finalist of the Photo Contest.
      If the photo does not pass additional verification of authenticity and compliance with the competition requirements, it does not receive the status of a finalist. The decision that the photo does not receive the status of a finalist due to the fact that it has not been verified for authenticity and compliance with the competition requirements is made by the Expert Commission of the competition by a simple majority of votes during in-person or absentee voting.
      If the photo has received the status of a finalist, but subsequently circumstances have been revealed indicating that the author of the photo violated the competition requirements, the work may be deprived of the status of a finalist. Such a decision can be made up until the day of the meeting of the Jury of the Photo Contest. The decision to exclude a work from the list of finalists is made by the Expert Commission of the competition by a simple majority of votes during in-person or absentee voting.
    10. The Organizer of the Photo Contest notifies the authors of the works that they have reached the "Semi-final" and "Final".
    11. The final assessment of the photographs that have reached the Final of the Photo Contest is given by the Jury. The Jury members summarize the results of the Photo Contest and determine its winners: one winner, one holder of the 2nd place and one holder of the 3rd place in each category.
    12. Each member of the Jury selects up to 3 (three) best works from among the finalists in each category of the Photo Contest and the Photo Contest for Children. The Counting Commission (selected by the Jury members) summarizes the votes cast for each photo. The photo that receives the maximum number of votes according to the results of the Jury's assessment becomes the winner of the category. The photo with the second total number of votes wins the 2nd place. The photo with the third total number of votes wins the 3rd place. If the works have received an equal number of votes, additional voting is conducted regarding them. If during the additional voting the works also received an equal number of votes, the winner of the category is determined by the Chairman of the Jury.
    13. Based on the results of the work of the members of the Jury and the Counting Commission, a protocol is drawn up indicating the winner, as well as the holders of the 2nd and 3rd places in each category.
    14. The members of the Jury have the right to transfer photos that have passed to the Final of the Photo Contest from one category to another.
    15. The entry of photographs to the Final of the Photo Contest is not a prerequisite for exhibiting the work at exhibitions and publication in the photo album of the Photo Contest.
    16. Winners in each category of the Photo Contest will receive a cash prize of 250,000 (two hundred fifty thousand) rubles, including personal income tax.
    17. Holders of the 2nd, 3rd place and finalists in each category of the Photo Contest receive the corresponding award certificate of the Photo Contest.
    18. The special prize "PEOPLE'S CHOICE AWARD" is given to a person who is determined by open voting on the Photo Contest website from among the finalists of the Photo Contest in all categories. The voting results are approved by the Photo Contest Jury.
    19. The special prize "RESERVED RUSSIA" is awarded for the best shot taken in specially protected natural areas (SPNA). The winner of the prize is determined by the partner of the Photo Contest – “VTB Bank” PJSC. The winner of the award receives a cash prize in the amount of 100,000 (one hundred thousand) rubles, including personal income tax.
    20. The winner of the Photo Contest prize "PEOPLE'S CHOICE AWARD" receives a gift set from the Society.
    21. The special prize "SHOT ON A CAMERA TRAP" is awarded for the best shot of animals in their natural habitat obtained using a camera trap or an automatic photography system. The winner of the prize is determined by the partners of the contest: the center “Amur Tiger” ANO and “PhosAgro” PJSC. The winner of the award will receive a cash prize from “PhosAgro” PJSC in the amount of 100,000 (one hundred thousand) rubles, including personal income tax.
    22. Special prize "SPECIAL PRIZE FROM THE RUSSIAN GEOGRAPHICAL SOCIETY". The Executive Directorate of the Russian Geographical Society will select three photographers among the winners of the Photo Contest "The Most Beautiful Country" over the last ten years, who will take part in one of the expeditions of the Russian Geographical Society in 2025.
    23. Special prize "NATURAL ART OBJECT". Photographs of a non-man-made object are accepted, demonstrating the beauty of nature in unusual color and compositional solutions, as well as evoking an emotional response from the viewer. The partner is the Art, Science and Sport Foundation. The winner of the award receives a cash prize in the amount of 100,000 (one hundred thousand) rubles, including personal income tax.
    24. The results of the Photo Contest are published on the Photo Contest websites photo.rgo.ru, photo-children.rgo.ru.
  10. License Agreement
    1. By participating in the Photo Contest, the Participant of the Photo Contest guarantees that:
      1. he/she is the author/legal representative of the author/representative of the copyright holder (in relation to photographs taken by means of camera traps for the category WILD ANIMALS) of the photographs/videos submitted to the Photo Contest and has the exclusive right to them, with the exception of archival photographs (in relation to the category LIVE ARCHIVE), in respect of which the Participant of the Photo Contest is not the author, but has the exclusive right or license, the amount of rights of which is identical to the amount of rights transferred to the Society in accordance with this section of the Regulations and allowing the Participant of the Photo Contest to transfer the corresponding amount of rights to the Society.
      2. photos/videos do not violate the legislation of the Russian Federation, do not contain offensive information, as well as information that is contrary to moral principles and generally recognized values;
      3. the content of photos/videos does not violate the rights of third parties;
      4. if third parties in court or in any other way challenge the Society's rights to use photos/videos, the Participant is obliged to take part in the proceedings on the side of the Society and prove the legality of the Society's use of photos/videos;
      5. if the Participant fails to prove the legality of the use and disposal of photographs/videos and the Society is held liable, the Participant is obliged to reimburse the Society within 10 (ten) calendar days from the date of entry into force of the decision of the court and/or other body considering the dispute legal costs , the amount subject to collection from the Society in favor of a third party, other costs associated with legal proceedings;
      6. in the categories providing for portrait photography or in the case of people participating in the Participant's videos, the Participant received a model release/consent (consent to the publication and further use of the photo/video by the Participant);
      7. in the event of claims against the Society from the owners of copyright and/or related rights, their authorized representatives or third parties regarding the use of photographs/videos by the Society, the Participant undertakes at his/her own expense to settle all disputes with third parties who have submitted the respective claims, and to compensate in this regard, damage to the Society.
    2. The legal representative of the minor Participant (the author of the photo/video) of the Photo Contest guarantees that he/she really is the legal representative of the child author of the works submitted to the Photo Contest.
    3. The copyright for the photos/videos submitted to the Photo Contest remains with the authors of the respective photos/videos.
    4. By taking part in the Photo Contest, the Participant, without charge, as a voluntary donation to the statutory activities of the Society, grants the Society the right (non-exclusive license) to use by the Society photographs/videos (hereinafter – “photographs” / “videos” / “works”) in the ways stipulated by the civil law of the Russian Federation, including:
      1. reproduction of a work, that is, the production of one or more copies of a work or part of it in any material form, including in the form of sound or video recording, the production in three dimensions of one or more copies of a two-dimensional work and in two dimensions of one or more copies of a three-dimensional work. In this case, the recording of a work on an electronic medium, including recording in the computer memory, is also considered reproduction;
      2. distribution of a work by selling or otherwise alienating of its original or copies;
      3. public display of a work, that is, any demonstration of the original or a copy of a work directly or on a screen using film, slide, television footage or other technical means, as well as demonstration of individual frames of an audiovisual work without observing their sequence, either directly or with the help of technical means at a place open to the public, or at a place where there is a significant number of people present who do not belong to the regular family circle, regardless of whether the work is perceived at the place of its display or at another place simultaneously with the demonstration of the work;
      4. import of an original or copies of a work for distribution purposes;
      5. rental of the original or a copy of the work;
      6. public performance of the work, that is, the presentation of the work in live performance or with the help of technical means (radio, television and other technical means), as well as the display of an audiovisual work (with or without sound accompaniment) at a place open to the public, or at a place where there is a significant number of persons who do not belong to the regular family circle, regardless of whether the work is perceived at the place of its presentation or display, or at another place simultaneously with the presentation or display of the work;
      7. broadcasting, that is, communicating a work to the public by radio or television. In this case, broadcasting is understood as any action through which a work becomes available for auditory and (or) visual perception, regardless of its actual perception by the public. Broadcasting the works on the air via satellite means receiving signals from a ground station by a satellite and transmitting signals from a satellite, through which the work can be brought to the attention of the general public, regardless of its actual reception by the public. Communication of encoded signals is recognized as broadcasting if decoding means are provided to an unlimited number of persons by the broadcasting organization or with its consent;
      8. communication by cable, that is, the communication of a work to the public by radio or television by means of a cable, wire, optical fiber or similar means. The message of encoded signals is recognized as a message by cable if decoding means are provided to an unlimited number of persons by the cable broadcasting organization or with its consent;
      9. retransmission, that is, reception and simultaneous communication on the air (including via satellite) or by cable of a complete and unchanged radio or television transmission or its essential part, communicated by air or by cable by an over-the-air or cable broadcasting organization;
      10. translation or other processing of the work. In this case, the processing of a work means the creation of a derivative work (editing, film adaptation, arrangement, staging, and the like). The processing (modification) of a computer program or database is understood as any of their changes, including the translation of such a program or such a database from one language into another language, with the exception of adaptation, that is, making changes carried out solely for the purpose of the functioning of a computer program or databases on specific technical means of the user or under the control of specific user programs;
      11. practical implementation of an architectural, design, urban planning or landscape gardening project;
      12. making the work available to the public in such a way that any person can get access to the work from any place and at any time of his/her own choice (making available to the public).
    5. The Participant of the Photo Contest grants the Society the right to publish photographs/videos, the right to use photographs/videos in the ways provided for in the section of the Regulations "License Agreement" on the territory of all countries of the world.
    6. The Participant of the Photo Contest grants the Society the right to include photographs/videos in any complex objects (films, other audiovisual works, theater performances, multimedia products, databases, etc.), as well as the right to include photographs/videos in any compound works. The Participant of the Photo Contest understands, accepts and agrees that the exclusive right to the complex and compound objects of intellectual activity specified in this clause, which may include photographs/videos, will belong to the Society, which in turn has the right to transfer such right to third parties.
    7. The Participant of the Photo Contest agrees that as a result of the processing of photographs/videos of the Photo Contest, the Society may create any other independent works, including, but not limited to, any audiovisual works, animation, advertising, promotional, image, information and announcement videos and clips, and also other results of intellectual activity and means of individualization, and materials. In this case, the Society will have the exclusive right, in full, to the new results of the intellectual activity and means of individualization, including the right to multiple (unlimited) use, in full, and/or in part (partial), and multiple (unlimited) disposal on a reimbursable and/or gratuitous basis of new results of the intellectual activity and means of individualization without limiting the territory and term at its discretion by any existing or likely to arise in the future ways that do not contradict the legislation of the Russian Federation.
    8. The Photo Contest Participant grants the Society the right to conclude sublicense contracts/agreements with third parties on reimbursable or gratuitous terms within the limits of the rights granted to the Society in accordance with the “License Agreement” section of the Regulations. At the same time, the Society has the right to independently determine the cost of sublicenses and not provide the Participant of the Photo Contest with reports on the use of photographs/videos and on the concluded sublicense contracts/agreements. The Participant of the Photo Contest understands, accepts and agrees that the Society is not liable to the Participants of the Photo Contest for the use of photographs/videos by third parties who have received the rights to use photographs/videos by way of sublicense.
      The Participant of the Photo Contest agrees that the Society has the right to place the photos/videos by the Participants who have received the status of the finalists of the Photo Contest on souvenir, printed and other products sold by the Society.
    9. The Participant of the Photo Contest agrees that the Society has the right to place the photos/videos by the Participants who have received the status of the finalists of the Photo Contest on souvenir, printed and other products sold by the Society.
    10. The term of the non-exclusive license, which grants the Society the right to use the photographs/videos by the Participants of the Photo Contest, is the period of validity of the exclusive right of the Participant of the Photo Contest to a photograph from the moment the photo is uploaded to the website of the Photo Contest.
    11. By uploading photos/videos to the website of the Photo Contest, the Participants of the Photo Contest automatically give their consent to the use of their name and the photographs/videos submitted to the Photo Contest for the statutory purposes of the Society, as well as consent to the use of photos/videos in the ways provided for in the section of the Regulations "License Agreement".
    12. Uploading photos/videos to the Photo Contest website confirms that the Participant of the Photo Contest understands all the conditions of the Regulations, he/she understands the legal consequences of failure to comply with the terms of the Regulations, agrees with the terms of the Regulations, and also understands and agrees with the amount of non-exclusive rights transferred to the Society in accordance with the "License Agreement" section of the Regulations.
    13. All funds received from the commercial use of photos/videos are directed by the Society strictly for the implementation of statutory activities, including the organization and conduct of the Photo Contest, popularization of the Photo Contest, exhibition activities of the Society, protection and preservation of rare species of animals.
  11. Final provisions
    1. The Organizer of the Photo Contest, when presenting the cash prize to the winners of the Photo Contest, acts as a tax agent and withholds personal income tax from the amount of the payment.
    2. Participation in the Photo Contest (the fact of registration on the Photo Contest website) means:
      1. full and unconditional acceptance by the Participant of the conditions and rules of the Photo Contest established by the Organizer, and agreement with the requirements set by the Organizer for participation in the Photo Contest;
      2. the Participant accepts obligations to comply with the conditions and rules of the Photo Contest established by the Organizer;
      3. consent to the storage and processing of personal data of the Participants in accordance with the legislation of the Russian Federation on personal data;
      4. consent to the use by the Society of the photographs submitted to the Photo Contest (uploaded to the Photo Contest website) for statutory purposes.
    3. The decisions of the Expert Commission and the Jury are final and not subject to revision.
    4. The Organizer of the Photo Contest does not comment on the grounds and reasons for making the decisions of the Expert Commission and the Jury.
    5. The Organizer is not responsible for non-fulfillment or improper fulfillment of its obligations resulting from failures in telecommunication and energy networks, actions of malicious programs, as well as unfair actions of third parties aimed at unauthorized access and/or disabling the Organizer's software and/or hardware complex.
    6. The Organizer of the Photo Contest reserves the right to make changes to the rules of the Photo Contest.
